I don't think it needs anything much to be distracted. Have you ever been in conversation with a passenger and missed a turning for instance, or found yourself on the wrong road as your brain was in autopilot mode?

That doesn't necessarily mean you were not concentrating on the actual driving though, it does imply you were not concentrating on what your destination should be.

Before someone so much as glances at their phone, should they need to park up and get out of the car first? If you agree with 'park up' but disagree with 'get out of the car' it's not much different from being stuck in traffic at traffic lights.

'Distractions should be removed' - so will you be disabling the radio in your car and looking into how you can make it impossible to adjust the heater controls anywhere other than on your own drive?

Anywhere else you're likely to go in the car other than on your own or friends/family's driveways is likely to be a public space, including parked up at the side of the road.

Law does make a special case for phone use in cars but the underlying point is all about due care and attention. Can a driver stood some time at traffic lights quickly (as in as quick as changing a radio station) glance at their phone to check the status screen safely? I would argue yes, but again would say the devil is in the detail. Can a driver safely watch a cliffhanger episode of Coronation Street or finish writing their report whilst driving (vehicle moving) through a town centre, of course not.

1st paragraph) Park up with the engine off and not in traffic is legal. You could argue that 'being on the road' is in traffic by definition, even if the engine's off and you're parked on a road side out of 'traffic', in the same way as the famous line of 'if he's not interfering with play, what's he doing on the pitch'. But I don't make the law.

2nd paragraph) It isn't about me, it's about people using their phone illegally. I don't do that, so any other non illegal issue (heater etc) isn't about me. However, I don't mind backing you up with a signature if you wish to try and make it like phones- illegal. There is still 'driving' when being distracted in the law. I'd imagine is someone hit someone and caused death or life changing injury, the police would be all over it with the car's ECU or likewise if suspicion of cause, even if the distraction wasn't looking to see the hamster doing 11 spins a minute on a tick tok upload. Sat navs use to is against the law, going by that link earlier.

Again, if you wish you could argue for a law change to allow 'quick glances' at mobile phones when in stationary traffic (or similar). Currently it's against the law to do so. So hopefully those who do it will get their points and hopefully get off the road and/or see their insurance rocket.

I thought your main point was about safety, now we're talking only about legality?

If we're still talking safety, was the bloke on the phone watching a video or briefly checking status screen to (e.g.) see if he'd received any messages? Was traffic moving or stood?

My main point is talking about people using a mobile phone illegally at the wheel of a vehicle.

Call it safety, illegality, irresponsibility, stupidity. If they use a phone illegally in a car, fingers crossed they get caught.

I'm not sure what the bloke, or any other the other 7 were doing, nor the driving instructor. It was illegal to use the mobile at the wheel of a car when in traffic.
