Disaster!

  • Be fit for purpose – for example, if you asked for a car that could tow a caravan, it must be able to do that.
I would think that this does not come into it
  • Be of satisfactory quality – for a used car, this takes into account the car’s age and mileage.
Possibly something here but with a car approx 23 years old and with best part of 140000 miles on the clock plus being a grey import with no real way to prove or disprove what might have gone on in Japan prior to import quite probably not going to hold up as they will say it has an advisory free mot and all the rest is normal wear and tear and to be expected which it would most likely be difficult to argue against.
  • Match its description – equipment/specs listed in the advert must be accurate.
Don't know about this as have never seen the original advert but would be worth checking against what the add says and the cars spec

If the car has any known defects, the dealer must make you aware of them before you buy it.


This might be were you could build a case. I have a mate who is a car dealer and I know that on the handover receipt he lists any known defects which he and the customers signs and each one keeps a copy.

If this has not been done maybe the fuel gauge not working or included could be used as a reason for returning for a refund although I do seem to remember you saying that you were being reimbursed from the dealer for the replacement module you have bought so might not be a reason as he could ague that he was paying for this to be sorted.

Can you think of anything else?

Yes there is...in a previous post I suggested using Colin Price who are specialists and fairly close to him. Turns out the garage he bought from is just next door to Colin!
I am sure Colin Price would be able to take a look at it and advise him on repair costs and viability.

Makes me wonder what the odds are on a garage selling a “ slightly run down” Elgrand right next door to a well known dealer

Maybe just how my mind works but with the time scales it is not outside of the realms of possibility that this van was taken as part ex for Elgrandmans van and then sold on to the lower market dealer next door as it was deemed not good enough to go on Colin's fore court giving Colin an even bigger profit on the deal.

Of course he could also have given over the odds for the trade in knowing that he was already assured a good profit on Elgrandsman's van and perhaps this is why Elgrandsman's van sold so quick as maybe Colin was able to go back to a customer who had previously shown interest and offer a better trade in.

Be interesting to know who done the mot on Parcels van.

Yeh I contacted them, denied all knowledge there was any problems with it (well they would say that wouldn't they).
Vehicle has gone back now, not my problem any more.
Just waiting for the refund as promised in a email an verbal agreement by dealer.

Weirdly, I actually bought a 150000 mile hyundai santa fe as a cheap winter car from the same place. The car seems OK, full dealer service history, last mot at hyundai cambridge. I have put over 3000 miles on it since november, only real issue has been a stone through the radiator, which is just bad luck.

The fact they have one company name on auto trader, a different one on the physical sign, another on the paperwork you sign for your 'non refundable deposit', and you pay a completely separate company the money by bank transfer tells you all you need to know.

I am not stupid, I saw every salesman trick and lie in the book. I know one of the door locks is screwed as it is making a very load screaming noise, and he literally told me that was normal and they all do that. He also told me it had a new battery and reconditioned alloys, and I told him I wasn't actually blind amd it was obvious none of those things were true. But it really looked ok and was happy to give them £3k for it, as it was literally the cheapest running FSH 4x4 I could find in a 100 mile radius! But they were obviously the dodgiest outfit I had ever been to, and the reviews show that if you know all its previous names.. They change the name of the company every couple of months to hide them.

Should have paid you in full before you let it go ..now you got no physical evidence and no cash ..I'm afraid they saw you coming .. probably fixing it up to throw back at you as there's no faults anymore.... hopefully you'll be lucky but would they let you take it away without payment ..they could string you along for a while now ..a visit to the police is in order I think and trading standards

Trading standards dont deal with it. Its only citizens advice bureau , now.
 
I didn't like to say it, but a few of the google reviews of the place got a few punters all over the place with supposed refunds.
